On the 26th of August, NASA, the Kenya opposition party led by Raila Odinga filed a petition disputing the declaration of Uhuru Kenyatta as president, and calling for the results to be thrown out. Citing irregularities by the IEBC, it has been a long strenuous week coupled with anticipation regarding the Supreme Court’s ability to deliver a fair verdict. In the petition, Mr. Odinga claimed that the poll was extensively flawed by irregularities while the electoral commission breached the constitutional as well as the legal provisions in the August 2017 poll. Through NASA senior lawyer Mr. Otiende Amollo, Raila stated that the results of the presidential elections were erroneously delivered according to Forms 34Bs.
Chief Justice David Maraga delivered the Supreme Court’s ruling on 1st September 2017, opining that the elections were not fairly conducted according to the Kenyan constitution. He also added that with regards to the findings, there must be a re-run, or a re-election, with the aim of arriving at justice. Since the illegalities affected the elections, Uhuru’s win has been nullified, Maraga declared. The nation has been left in shock, as it was not expected that the verdict would be made in favor of the opposing party.
This is the first judgment in Africa that has made history in regards to irregularly conducted elections. Giving his speech after the court ruling, Orengo stated that Kenya will have a new presidential election in sixty days. Orengo spoke after the court nullified Uhuru’s presidential win after a long week of court proceedings. Adding that impunity must be punished, Orengo stated that history shall never repeat itself in Kenya. The court gave the minority a chance to read their judgment and feelings on the recently concluded elections. According to Kalonzo Musyoka, the IEBC must be replaced because they are not capable of handling credible and fair elections.
